The 2018 Farm Bill removed hemp products from the federal controlled substances list, making hemp legal as long as it contained less than 0.3% THC based on dry weight. However, the bill’s language specified 0.3% delta-9-THC, leaving a loophole for the production and unregulated sale of delta-8 products. This lack of regulation allows for easy access to these products, often without age verification, in places like gas stations and online retailers.
